Welcome to Aubergines Lab! These terms and conditions (“Terms”) govern your use of the website platform (the “Service”), a subscription-based service that provides access to premium digital content. By signing up, you agree to be bound by these Terms, our Privacy Policy, and any other guidelines or policies we may publish. Please read them carefully before using the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including trial users, subscribers, and visitors.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to subscribe to the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

3. Subscriptions

• • Subscription Plans: Our Service is available on a subscription basis, with various plans offering different levels of access and benefits. Subscription options are displayed during signup, and you will be billed according to the plan you select.
  • 1 Euro Cent Trial: We offer a one-time introductory trial for new users at a rate of €0.01, which grants access to all website features for a limited period of trial duration (from 1 to 7 days depending of the offer). After the trial period ends, your subscription will automatically renew at the regular rate unless canceled before the trial ends (see Section 5 for cancellation details).
  • Auto-Renewal: Subscriptions automatically renew at the end of the subscription period unless canceled prior to renewal. By subscribing, you authorize us to charge your payment method on a recurring basis. You will be charged in advance for each billing period.
  • Pricing: Subscription fees and terms may vary by plan and location and are subject to change. We will notify you of any price changes in advance, and the new rates will apply to the next billing cycle.

4. Payment and Billing

• • Payment Methods: We accept major credit cards, debit cards, and other payment methods made available on the platform. You agree to provide valid payment information and keep it up to date.
  • Authorization: By providing a payment method, you authorize Aubergines Lab to charge the fees for the subscription plan you selected. All payments are non-refundable, except as explicitly stated in these Terms.
  • Failed Payments: If your payment fails, your subscription may be suspended or canceled. You are responsible for any unpaid amounts. We reserve the right to retry failed payments.

5. Cancellations and Refunds

• • Cancellation Policy: You can cancel your subscription at any time by accessing your account settings. Cancellations take effect at the end of the current billing cycle, and you will continue to have access to the Service until that time. No refunds will be issued for partial months or unused portions of a subscription.
  • Trial Cancellations: You may cancel the 1 Euro Cent Trial at any time during the trial period to avoid being charged the full subscription rate. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the regular price.
  • Refund Policy: Except as required by law, subscription fees are non-refundable. We may, in our sole discretion, offer refunds or credits in exceptional circumstances, but this is not guaranteed.

6. License and Use

• • License: Subject to your compliance with these Terms, Aubergines Lab grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes.
  • Prohibited Uses: You may not use the Service for any unlawful or prohibited purposes, including:
    • • Reselling or redistributing the content;
      • Sharing your account login credentials;
      • Reverse engineering or attempting to gain unauthorized access to the platform;
      • Uploading malicious software or violating the security of the platform.

7. Account and Security

• • Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breaches.
  • Account Termination: We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activities that harm the Service or its users.

8. Intellectual Property

All content and materials provided through the Service, including but not limited to text, graphics, logos, and software, are the property of Aubergines Lab or its licensor and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our explicit consent.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted or error-free, or that defects will be corrected. Use of the Service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Aubergines Lab and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from or related to your use of the Service.

11. Indemnification

You agree to indemnify and hold Aubergines Lab harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your violation of these Terms or misuse of the Service.

12. Modifications to the Service and Terms

We may modify the Service or these Terms at any time. Any changes will be posted on this page or communicated to you via email. Your continued use of the Service after any changes to the Terms constitutes your acceptance of those changes.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of The Netherlands, unless otherwise required by law.
